1. Operator and scope
These terms govern the use of the AI Model Social website and service operated by Miroslav Smik, Company ID 54552206. The service is currently in early access. A paid subscription agreement is formed when an order is submitted through the production Stripe checkout and confirmed on a durable medium.
2. What the service provides
AI Model Social is a software service for creating the identity of a fictional AI model, securely storing media, preparing copy, hashtags and schedules, and publishing through supported official interfaces. Features dependent on Meta, TikTok, Fanvue, Stripe or another provider are available only within that provider's rules, permissions and technical interfaces.
3. Account and authorized user
Paid subscriptions are intended for individuals—consumers aged 18 or over who are legally entitled to enter into an agreement. Checkout does not collect company billing details or VAT IDs. Users are responsible for accurate information, protecting their email account and personally completing verification required by a social network. AI Model Social does not request passwords, SMS codes or documents intended for a social platform.
4. Content and processing licence
The user retains ownership of their content. By uploading content, the user grants the operator a non-exclusive, revocable permission limited to providing the service to store, technically modify, analyse and send the content to selected platforms. The user confirms that they hold all necessary copyright, licence, personality and consent rights.
5. AI persona and permitted content
Every persona must be clearly fictional and an adult. A user must not use the likeness, voice or identity of a real person without demonstrable authorization. The binding limits are set out in the Permitted AI Content Policy. The operator may block content or an account where there is a reasonable suspicion of illegality, misuse or breach of platform rules.
6. AI outputs and results
Copy, hashtags, trends, schedules and other recommendations are automated suggestions and may contain inaccuracies. The user is responsible for the final autopilot settings and may pause it at any time. The service does not guarantee reach, income, account approval, acceptance of a post or virality.
7. Prices, subscriptions and payments
The total price, currency, taxes, trial period, billing frequency, automatic renewal and cancellation terms are shown immediately before ordering. Payment details are processed by Stripe; the operator does not store the full payment card number. A subscription can be managed or cancelled through the customer payment portal. Cancellation stops future renewal and does not limit the consumer's statutory rights.
8. Withdrawal, defects and complaints
For a distance contract, the consumer has statutory rights, including the right to withdraw in the cases and time limits provided by law and rights relating to defects in the digital service. The public function Withdraw from the contract here is available without sign-in; the procedure, model notice, complaints and alternative dispute resolution are available on the page Complaints and withdrawal. These terms do not limit rights that cannot legally be excluded by contract.
9. Availability and third parties
The operator strives to provide a secure and available service but does not guarantee uninterrupted availability of third-party interfaces. Changes to rules, audits, limits, outages or decisions by social networks may temporarily restrict features. Where possible, the user will be informed in the application of a material restriction.
10. Account suspension and termination
The user may request account termination. The operator may restrict or terminate an account for a serious or repeated breach of these terms, a security risk or a legal obligation. Unless prevented by security or law, the user will be informed of the reason and available remedy.
11. Liability
Each party is liable for damage under generally applicable law. The operator is not liable for a decision, rule change or outage of a third-party platform beyond its control. Nothing in these terms excludes or limits liability that the law does not permit to be excluded or limited.
12. Changes to the terms
These terms may be changed due to service development, security or legal requirements. The user will be informed reasonably in advance on a durable medium of a material change to an existing paid subscription. If a change negatively affects the digital service, the consumer retains all statutory rights.
13. Governing law and contact
Legal relations are governed by the laws of the Slovak Republic, without prejudice to consumer protection under the mandatory rules of the consumer's country.
